Supreme Court Deals Major Blow to Planned Parenthood — Refuses to Block Arkansas Law

The U.S. Supreme Court dealt a major blow to Planned Parenthood on Tuesday, refusing to take up a case against an Arkansas law strictly limiting medication-induced abortions.

The high court’s rejection means a 2015 law could soon take effect in the conservative state. The controversial measure requires abortion providers to have contractual agreements with doctors who have hospital admitting privileges, Bloomberg reported.

The lawsuit, filed by the only two Planned Parenthood clinics in Arkansas, argued no obstetrician in the state would agree to the contract required by the law. It should be noted that pair of clinics only offers medication-induced abortions, which can be performed until the ninth week of pregnancy.

The legislation would practically eliminate all but surgical abortions, according to The New York Times.

“This will particularly affect women who strongly prefer medication abortion,” the group told the Supreme Court, “including those who find it traumatic to have instruments placed in their vaginas because they are victims of rape, incest, or domestic violence, as well as women for whom medication abortion is medically indicated and safer than surgical abortion.”

A shift in the court
The Supreme Court’s decision, which came without an explanation, marks a shift in favor of the pro-life movement.

In 2016, the high court shot down a similar Texas law that could have shuttered a majority of the state’s abortion clinics. The justices rejected the legislation, in part, because of a stipulation requiring abortionists to have hospital admitting privileges.

The Arkansas lawsuit claimed this current case has “virtually identical factual and legal issues” as the rejected Texas legislation.

Arkansas Attorney General Leslie Rutledge defended the legislation, saying there “is no right to choose medication abortion.”
